₹5 lakh fine if Ram Temple donation case accused are represented: Ayodhya lawyers' body warns members

The Ayodhya Bar Association has issued a stern warning to its members, announcing that any lawyer who represents the accused in the alleged Ram Temple donation fraud case will be fined ₹5 lakh. The move reflects the strong public sentiment surrounding the case, which involves allegations of misappropriation of donations collected in the name of the Ram Temple.

The decision was taken during a meeting of the lawyers' body, which resolved that no member should appear on behalf of the accused. The association said the allegations had deeply hurt the religious sentiments of millions of devotees and described the alleged offence as one affecting public faith.

Why did the Bar Association issue the warning?

According to the association, the decision was prompted by the seriousness of the allegations involving donations linked to the Ram Temple. Members argued that the accused had allegedly exploited the faith of devotees, making the matter one of exceptional public importance.

To reinforce its stand, the Bar Association resolved that any member violating the decision by appearing for the accused would be liable to pay a penalty of ₹5 lakh. The association also appealed to advocates to respect the collective decision.

What is the Ram Temple donation case?

The controversy centres on allegations that funds collected in the name of the Ram Temple were fraudulently diverted or misused. Police have registered a case against individuals accused of cheating devotees by collecting donations under false pretences.

The investigation gained momentum after authorities arrested an aide of senior Ram Temple Trust functionary Champat Rai. However, temple authorities and the Trust have rejected attempts to link the alleged fraud directly to the official Ram Temple donation system, maintaining that the case concerns individual actions rather than the Trust's financial operations.

Legal and ethical debate

The Bar Association's resolution has triggered debate within legal circles over an accused person's constitutional right to legal representation.

Under Indian law, every accused person is entitled to legal counsel and a fair trial, irrespective of the nature of the allegations. While bar associations may pass resolutions expressing collective opinions, courts have consistently held that advocates cannot be prevented from representing clients solely because of the nature of the case.

Legal experts note that the legal profession requires lawyers to ensure access to justice, and disciplinary action restricting representation may invite judicial scrutiny if challenged.

Investigation continues

Police are continuing their probe into the alleged donation fraud, examining financial records and other evidence to determine the extent of the alleged scam. Authorities are yet to disclose the full amount allegedly involved or whether additional arrests will follow.

The case has attracted nationwide attention due to the religious significance of the Ram Temple and the large number of devotees who contribute donations.
