New Delhi: A Delhi court on Monday deferred the decision on framing charges against Rashtriya Janata Dal (RJD) chief Lalu Prasad Yadav and others in the Enforcement Directorate's (ED) money-laundering case linked to alleged irregularities in the award of IRCTC hotel contracts.
Special Judge Vishal Gogne adjourned the matter to September 10. The postponement came after the judge was transferred from the Rouse Avenue courts to the Dwarka district court, where he has been appointed Additional Principal Judge of a Family Court.
IRCTC Case Linked to Hotel Contracts
The case stems from alleged irregularities in the awarding of operational contracts for two Indian Railway Catering and Tourism Corporation (IRCTC) hotels to a private company during Lalu Prasad Yadav's tenure as Union Railway Minister.
The alleged irregularities form part of a wider set of cases involving the former Railway Minister and members of his family.
The ED's proceedings are connected to the alleged financial irregularities arising from the hotel contracts, while a separate CBI case has also been registered in connection with the matter.
Charges Already Framed in CBI Case
The latest development comes after a Delhi court had previously framed charges in the CBI's IRCTC case.
On October 13 last year, charges including cheating, criminal conspiracy and offences under provisions of the Prevention of Corruption Act were framed against Lalu Prasad Yadav, his wife Rabri Devi, son Tejashwi Prasad Yadav and 11 others.
The CBI case concerns the same alleged irregularities involving the operation of two IRCTC hotels.
The framing of charges means the court found sufficient grounds at that stage to proceed with the criminal case; it does not amount to a finding of guilt against the accused.
Why the Court Deferred the ED Case
The immediate reason for Monday's adjournment was the transfer of Special Judge Vishal Gogne.
Court staff informed the parties that the matter had been adjourned following the judge's transfer to the Dwarka district court.
The court will now take up the matter on September 10, when the proceedings concerning the framing of charges in the ED case are expected to resume.
Lalu Yadav's Role as Railway Minister
The allegations relate to decisions taken when Lalu Prasad Yadav was serving as Railway Minister.
Investigators have alleged irregularities in the granting of contracts for the operation of two IRCTC hotels to a private firm.
The case has remained politically significant because it involves one of Bihar's most prominent political families and has been pursued alongside other corruption-related cases involving the RJD leadership.
Wider Legal Cases Against the Yadav Family
The IRCTC matter is separate from the land-for-jobs case, another major investigation involving Lalu Prasad Yadav and members of his family.
A Delhi court had also been dealing with proceedings related to the ED's land-for-jobs case. In an earlier hearing, the court had adjourned the framing of charges in that matter to September 30.
The two cases have continued to attract considerable political attention in Bihar, particularly as the RJD remains a major opposition force in the state.
What the Court Had Observed Earlier
In proceedings related to the CBI's land-for-jobs case, the court had made strong observations about allegations concerning Lalu Prasad Yadav's tenure as Railway Minister.
In the IRCTC case, however, the proceedings concern alleged irregularities in the award and operation of hotel contracts.
The distinction between the different cases is important as the investigations involve different allegations and legal proceedings.
Political Significance
The legal proceedings involving Lalu Prasad Yadav and his family have repeatedly become a point of political confrontation between the RJD and the BJP-led political establishment.
The RJD has maintained its political position while the investigative agencies have pursued the cases through the courts.
The latest adjournment is procedural and does not resolve the allegations or determine the guilt or innocence of any accused person.
What Happens Next?
The Delhi court is now scheduled to take up the ED's IRCTC case on September 10.
The court will consider the next stage of proceedings concerning the framing of charges against Lalu Prasad Yadav and the other accused.
The outcome of the hearing could determine how the money-laundering case moves forward as the court continues to examine the allegations arising from the alleged irregularities in the IRCTC hotel contracts.
For now, the framing of charges has been deferred, with the next hearing set for September 10.
