SC Seeks Goa Response to Tarun Tejpal's Challenge Against Rape Conviction

New Delhi: The Supreme Court on Friday sought the Goa government's response to a plea filed by former Tehelka editor-in-chief Tarun Tejpal, challenging his conviction and 10-year rigorous imprisonment sentence in a 2013 rape case.

A bench comprising Justices M M Sundresh and Prasanna B Varale issued notice on Tejpal's appeal. The bench also issued notice to Tejpal on a separate appeal filed by the Goa government seeking enhancement of his sentence to life imprisonment.

What is Tarun Tejpal challenging?

Tejpal has approached the Supreme Court against the August 6, 2026 judgment of the Bombay High Court's Goa bench, which overturned his acquittal by a trial court in 2021 and convicted him in the case.

The High Court sentenced him to 10 years' rigorous imprisonment after finding him guilty of sexually assaulting a junior woman colleague inside a hotel elevator during an event in Goa in November 2013.

Tejpal's appeal challenges the High Court's findings and seeks relief from the conviction and sentence.

Supreme Court issues notice to Goa

During Friday's hearing, senior advocate Kapil Sibal, appearing for Tejpal, told the bench that the case involved the reversal of an earlier acquittal.

Sibal also sought consideration of Tejpal's plea for suspension of the sentence, pointing out that his client had already surrendered in compliance with the Supreme Court's earlier direction.

The bench said it would specify a date for hearing the matter. Reports indicate that the appeals are expected to be taken up in October.

Tejpal surrendered earlier this month

The Supreme Court had on August 25 rejected Tejpal's request for exemption from surrendering to serve the sentence and directed him to surrender within the prescribed period.

Tejpal subsequently surrendered before a Goa court on September 14 and was taken to Central Jail at Colvale in North Goa. The surrender was a procedural step required before his appeal could be considered on merits.

Goa seeks life imprisonment

The Goa government has separately challenged the 10-year sentence awarded by the High Court and has sought its enhancement to life imprisonment.

The state has argued that the punishment imposed by the High Court was inadequate considering the nature and gravity of the offences for which Tejpal was convicted. The state's appeal will now be considered alongside Tejpal's challenge.

How the case reached the Supreme Court

The case dates back to November 2013, when allegations were made that Tejpal sexually assaulted a junior colleague inside an elevator at a hotel in Goa.

A trial court in Goa acquitted Tejpal in May 2021. The Goa government challenged that decision before the Bombay High Court.

On August 6, 2026, the High Court overturned the acquittal, convicted Tejpal and sentenced him to 10 years in prison.

Tejpal has maintained his legal challenge against the High Court verdict. The Supreme Court's notice does not amount to a decision on the merits of his appeal.

What happens next?

The Supreme Court will hear both sides of the legal dispute: Tejpal's challenge to his conviction and sentence, and the Goa government's plea seeking a life sentence.

For now, the Bombay High Court's conviction and 10-year sentence remain in force, while the Supreme Court considers the appeals.

The next hearing date is to be specified by the top court.
