SC Refuses to Entertain Plea Against Influencer Nazia Elahi Khan Over 'Derogatory' Remarks on Prophet Muhammad
The Supreme Court declined to entertain a petition seeking action against influencer Nazia Elahi Khan over her alleged derogatory remarks on Prophet Muhammad. Supreme Court directs petitioner to approach appropriate forum
The Supreme Court on Wednesday declined to entertain a petition seeking action against social media influencer Nazia Elahi Khan over her alleged derogatory remarks about Prophet Muhammad, observing that the petitioner should pursue remedies available under the law before the appropriate authority.
A Bench of the apex court refused to examine the matter directly, indicating that the petitioner was at liberty to approach the competent forum in accordance with the legal process. The court did not make any observations on the substance of the allegations.
The order comes amid continuing legal scrutiny of social media content and the responsibilities of online creators under India's criminal laws.
Court refrains from commenting on allegations
During the hearing, the Bench clarified that it was not expressing any opinion on whether the allegations against the influencer were correct or otherwise.
Instead, the judges said the legal framework provides appropriate mechanisms for individuals seeking redress and that such remedies should be exhausted before approaching the Supreme Court.
The plea was accordingly disposed of, with liberty to the petitioner to take recourse to other legal remedies available under the law.
Case relates to alleged remarks on social media
The petition was filed over remarks allegedly made by Nazia Elahi Khan on social media that the petitioner claimed were derogatory towards Prophet Muhammad and hurt the religious sentiments of members of the Muslim community.
The petitioner sought judicial intervention and appropriate legal action against the influencer.
However, the Supreme Court chose not to entertain the matter at this stage, reiterating the importance of following the prescribed legal process.
Legal remedies remain available
Under Indian law, complaints relating to alleged offences involving online content can generally be pursued before law enforcement agencies or other competent judicial forums, depending on the nature of the allegations.
The Supreme Court's refusal to entertain the plea does not amount to a determination on the merits of the case. Instead, it indicates that the petitioner should first avail of the remedies provided under the existing legal framework.
Debate over online speech continues
The case adds to the growing number of legal disputes involving content shared by influencers and public figures on social media platforms.
Courts across the country have increasingly been called upon to balance the constitutional right to freedom of speech with laws intended to prevent hate speech, protect religious harmony and address content that may incite public disorder.
The matter is likely to proceed before the appropriate forum if the petitioner chooses to pursue the remedies indicated by the Supreme Court.
