Residents of Vaibhav Khand Windsor Park Society in Ghaziabad recently protested against alleged short-term and daily rentals of residential flats. Residents raised concerns about frequent movement of outsiders, security and the use of residential apartments for Airbnb-style accommodation. They also submitted a complaint to several authorities, including the District Magistrate, Police Commissioner, Ghaziabad Development Authority, Nagar Nigam and Tourism Department. 

According to reports, residents alleged that some flats, particularly studio apartments in Towers A and B, were being offered for short stays and, in some cases, without the required registration or police verification. These are allegations made by residents and do not by themselves establish that every such rental was unlawful. 

The dispute raises an important question for flat owners: Can a residential apartment legally be used for Airbnb or homestay purposes?

Can You Legally Run an Airbnb From a Residential Flat?

There is no single nationwide rule that automatically makes every Airbnb-style rental either legal or illegal.

The legality can depend on several layers of regulation, including:

Can an RWA Evict an Owner From Their Own Flat?

An RWA generally cannot simply remove an owner from their own flat or terminate their ownership rights because the society objects to an activity.

However, the association can enforce valid bye-laws and other governing documents through the remedies available under applicable law. Depending on the jurisdiction and property structure, this may include notices, permitted penalties or seeking an injunction.

The precise powers of an RWA can also differ depending on whether the property is freehold, leasehold or governed by a particular apartment or cooperative-housing framework. 

Before putting a residential flat on a short-term rental platform, homeowners should check the following:
