A sessions court in Pune has sentenced Bhimrao Kamble to death after convicting him of the rape and murder of a three-year-old girl in Nasrapur, describing the crime as falling within the "rarest of rare" category that warrants the maximum punishment under law.
The court directed that Kamble be "hanged till death" after finding him guilty of sexually assaulting and killing the child. The judgment came after the prosecution presented evidence linking the accused to the crime, which had shocked the local community.
The incident took place in Nasrapur, located in Pune district, where the young victim had gone missing before her body was later recovered. Police launched an investigation that led to Kamble's arrest, and a chargesheet was subsequently filed under relevant provisions of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO) Act.
During the trial, the prosecution argued that the evidence established the accused's guilt beyond reasonable doubt. After examining the material on record, the court held that the nature of the offence, the age of the victim and the brutality involved placed the case in the "rarest of rare" category, making it fit for capital punishment.
The phrase "rarest of rare" is a legal doctrine developed by the Supreme Court, under which the death penalty is reserved for exceptional cases involving extreme brutality or circumstances where life imprisonment is considered inadequate.
The verdict has been welcomed by the victim's family and many local residents, who had demanded stringent punishment following the crime. At the same time, the legal process is not yet complete. Under Indian law, every death sentence awarded by a trial court must be confirmed by the jurisdictional High Court before it can be carried out.
The convict also has the right to challenge the verdict before higher courts and, if the sentence is upheld, may pursue other legal remedies available under the law.
The case once again highlights concerns over crimes against children and has renewed calls for swift investigation, speedy trials and stronger measures to ensure the safety of minors across the country.
