Delhi Court Seeks Police Report on FIR Plea Against Student CJP Activist, Father

New Delhi: A Delhi court on Wednesday sought an action taken report from the Delhi Police on a plea seeking registration of an FIR against student activist Nishu Azad and her father Sanjay Azad over four social media posts that the complainant alleges contain derogatory references to Hindu deities.

Chief Judicial Magistrate Mridul Gupta of the Patiala House Courts issued notice to the Delhi Police and asked the Station House Officer of Parliament Street Police Station to submit details of the action taken so far. The matter has been listed for further hearing in January 2027.

What is the FIR plea about?

The plea was filed by advocate Amita Sachdeva, who had earlier approached the Delhi Police with a complaint concerning posts allegedly uploaded from Azad's X account.

According to the complaint, four posts published between September 2023 and August 2026 allegedly contained objectionable references to Lord Shiva, Lord Krishna, Goddess Saraswati and Goddess Durga. The complainant has alleged that the posts remained publicly accessible despite a request for their removal.

Sachdeva has sought registration of an FIR under Sections 299 and 196 of the Bharatiya Nyaya Sanhita (BNS), along with applicable provisions of the Information Technology Act. The complaint alleges that the posts were deliberately published with an intention to outrage religious feelings and promote enmity. These are allegations made in the complaint and have not been established by the court.

Why has Nishu Azad's father been named?

The complaint also names Sanjay Azad, alleging that the social media account was operated by his daughter from their household and that the allegedly offending material was not removed after notice.

Because the complaint identifies Nishu Azad as a minor, her father has been named in the proceedings in his capacity as her guardian, according to reports on the complaint.

The court's Wednesday order is a direction for the police to report on the action taken so far. It is not a finding that the alleged offences occurred, nor is it an order directing immediate registration of an FIR.

Case comes amid CJP protest controversy

The latest proceedings come against the backdrop of a separate controversy surrounding a Cockroach Janta Party (CJP) protest at Delhi's Jantar Mantar in June.

Sanjay Azad had allegedly been assaulted during the protest. Delhi Police later arrested influencer Swatantra Bhardwaj in connection with the alleged assault. Bhardwaj has been granted interim bail in that case, subject to court conditions, according to reports.

The FIR plea concerning the social media posts is a separate legal matter from the alleged assault case.

Police response awaited

The Patiala House court has now sought the Delhi Police's report before considering the matter further. The police response is expected to indicate what action, if any, has already been taken on the original complaint.

The case will next come up in January 2027. Until then, the allegations concerning the social media posts remain subject to the legal process.
