The Delhi High Court has set aside the conviction and sentence of a former Indian Army major general in a disproportionate assets case, ruling that the prosecution had failed to prove the allegations beyond reasonable doubt.
In its judgment delivered on Wednesday, the High Court allowed the appeal filed by the retired officer against the trial court's conviction under provisions of the Prevention of Corruption Act. The case stemmed from allegations that the former senior Army officer had amassed assets disproportionate to his known sources of income during his tenure in public service. Following an investigation, a trial court had convicted him and imposed a sentence under the Prevention of Corruption Act. The officer subsequently challenged the verdict before the Delhi High Court.
While examining the appeal, the High Court scrutinised the evidence relied upon by the prosecution, including the assessment of the officer's income, expenditure and assets. The bench concluded that significant deficiencies remained in the prosecution's case and that it had failed to establish guilt to the standard required in criminal law.
