The Supreme Court has reiterated that every person appearing before the court is treated equally, during proceedings involving a defamation complaint against Congress leader and Leader of Opposition Rahul Gandhi.

The observation came as the bench dealt with arguments from the complainant's side in the case. The court's comments underline the principle that judicial proceedings are governed by law rather than the political status or public profile of the parties involved.

‘Everyone is equal before us’

During the hearing, the court reportedly told the complainant's side: “Everyone is equal before us.”

The observation assumes significance because Rahul Gandhi is currently the Leader of Opposition in the Lok Sabha and is involved in several politically sensitive legal cases.

The Supreme Court has repeatedly emphasised that proceedings involving political leaders must be decided according to applicable legal principles and the facts of the individual case.

Rahul Gandhi faces multiple defamation cases

Gandhi has faced several criminal defamation proceedings over remarks made during political speeches.

In one recent case concerning his comments about Hindutva ideologue Vinayak Damodar Savarkar, the Supreme Court in August 2026 quashed the criminal defamation proceedings and the magistrate's summoning order. The bench held that the requisite sanction from the Uttar Pradesh government had not been obtained, making continuation of the proceedings legally unsustainable.

That case had originated from a complaint concerning Gandhi's remarks about Savarkar. The Uttar Pradesh government had opposed Gandhi's plea and argued that his statements were intended to promote hatred and enmity. The Supreme Court ultimately held that the required sanction was absent.

What the latest remark means

The Supreme Court's statement that everyone is equal before it does not, by itself, decide the merits of the defamation allegations against Gandhi.

A criminal defamation proceeding can continue or be dismissed depending on the applicable law, procedural requirements and evidence. Any observations made during a hearing also need to be distinguished from a final judicial finding on guilt or innocence.
